General Remarks

This estimation is based on discussions with the client and cannot be used in any way as a basis for initiating projects.

The duration of the various items does not guarantee lead time if it depends on further input.

A concrete timing and delivery point will be indicated upon approval of this document.

Any change in briefing will result in a new estimation.

Material/information provided late by the client will result in missing sprints/deadlines with at least the duration of the delay + 2 working days.

Intellectual Property

Ohana retains all intellectual property rights relating to the created content.

Upon full payment of the due fees, the client has the right to use the delivered content according to the agreed purposes.

The client is not permitted to reproduce or modify the content without prior written consent from Ohana.

Revisions and Changes

The quote includes a specific number of revision rounds as agreed upon between Ohana and the client.

Additional revisions may be subject to additional costs.

Revision requests must be clear and in writing submitted by the client and will be evaluated based on the originally agreed specifications.

Changes outside the original scope may result in additional costs and may affect the project deadline.

Confidentiality

Both parties undertake to keep strictly confidential all confidential information obtained during the project.

Confidential information includes all non-public data and materials, including but not limited to business information, strategies, financial data, and technical details.

Both parties will take reasonable steps to ensure the confidentiality of such information and will not disclose it to third parties without prior written consent from the other party.

Liability

Ohana is not liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to loss of profits, business interruptions, loss of information, or other intangible losses, arising out of the use of or inability to use the delivered content.

The total liability of Ohana, regardless of the cause of the damage, will in no event exceed the total compensation for the services rendered.
